Benefits & Status Changes
The following are questions that may be asked by manager and/or employees. These FAQ’s are also designed to help human resources professionals respond to FLSA inquiries.
Will my title change?
Your title might change since we cannot have both overtime-eligible and non-overtime-eligible employees in the same title. Any title change will be finalized once the review process is completed.
Will my grade change?
No. As long as you remain in your current position, your grade will not change. At some point after July 1, you will be given a choice to either remain an M&P salaried overtime-eligible employee or join the Local 34 collective bargaining unit. The University and Local 34 are discussing how the transition will impact grades. Before you are asked to make this choice, those issues will be resolved and we will communicate all the details to you.
Will my benefits change?
No, your benefits will not change because you are now deemed to be overtime eligible. At some point after July 1, you will be given a choice to either remain an M&P salaried overtime-eligible employee or join the Local 34 collective bargaining unit. The University and Local 34 are discussing how the transition will impact benefits. Before you are asked to make this choice, those issues will be resolved and we will communicate all the details to you.
Will my vacation and sick time accrual change?
Your accruals will not change and you will not lose any accrued but unused vacation, personal or sick days that are in line with the Personnel Policies and Procedures. At some point after July 1, you will be given a choice to either remain an M&P salaried overtime-eligible employee or join the Local 34 collective bargaining unit. The University and Local 34 are discussing how the transition will impact vacation and sick time accruals. Before you are asked to make this choice, those issues will be resolved and we will communicate all the details to you.
Why are you speaking to the leaders of Local 34 about the redefined positions?
We initiated discussions with Local 34 to address this issue in a cooperative spirit. Many of the employees in the positions that have been redefined as overtime eligible perform work that resembles some of the work described in positions falling within the Local 34 bargaining unit.
Under the agreement with Local 34, what choices will I have?
You will have an opportunity to choose between remaining an overtime eligible M&P employee or becoming a member of the collective bargaining unit. The choice will be completely up to you. There are many unanswered questions relating to pay and benefits should an employee choose to transition to the bargaining unit, so we are meeting with Local 34 to establish what rules will apply. Once these transition issues have been resolved with Local 34, it will be clear what the implications will be if a employee whose position has been redefined as overtime-eligible chooses to join the bargaining unit. At that time, you will be able to exercise your choice.
When will you know the answers to those questions?
The University and Local 34 have already begun those discussions and the parties expect to resolve all the issues this summer.
If I choose to join the collective bargaining unit will I have to join the Union?
Any individual in the bargaining unit can choose to join the Union or decline membership. Local 34, as the certified bargaining agent for C&T Union positions, represents and collects dues (or fees in lieu of dues) from all employees covered by the contract, whether members or not. We do not anticipate this arrangement will change as a result of our current discussions with Local 34.
Will anything change for me on July 1?
No, you will remain an M&P employee, categorized as salaried, non-exempt meaning you will now be eligible for overtime payments. No other change will occur on that date. You will continue in your same position performing the same duties with the same pay, grade and benefits. Once the discussions with Local 34 are concluded, we will communicate to you the results of those discussions and what your options will be going forward. In this regard, there is no decision you must make on July 1.
Will I receive my merit increase on July 1?
Individual M&P employees are in the merit pool and as in years past, will be eligible for merit consideration that will become effective on July 1st. You will be notified by your supervisor during the months of June and July regarding your individual merit pay treatment.

Human Resources Representatives will be available to meet with any managers or employees whose position is affected by this change in overtime eligibility, and to assist in determining necessary payments.
